Voting caper and Reconstruction-era politics gave the election of 1876 to the Republican Rutherford B. Hayes, though 51 percent of the popular vote went to the Democrat Samuel J. Tilden. In 1888 the Democrat Grover Cleveland won 92,000 more popular votes than the Republican Benjamin Harrison, but Harrison got 58 percent of the electoral votes. This odd outcome was possible because of Clevelands commodious but otiose popular margins in the Democratic south-central while nearly losing the large industrial states of the North.
In none of these contests was the victors right to reign over seriously challenged. But if totally popular votes are counted, the loser in a track as close as those of 1960, 1968 and 1976 might well guide a recount. The Electoral College has deliver us from such crises of legitimacy because giving the winner all of! a states electoral votes usually magnifies the popular vote winners margin. Without the winner-take-all linguistic rule power would shake up from large heterogeneous states, which tend to river basin their popular votes somewhat evenly between the two major parties, to smaller more homogeneous states, where Presidential candidates could build bigger popular pluralities.
